8 - Our web hosting packages are offered to the customer based on the hardware and software ordered. We aim to provide the latest available Operating System (inc. patches and updates) unless told otherwise by the customer.
9 - In the very unlikely event that a hardware should fail, we aim to replace the failed device (after we made intensive checks) at our own expense and no money will be charged to the customer
10- Servers which require additional IP addresses will be upgraded free of charge (ie : Additional RAM / Different Processor where necessary).
11 - Additional IP addresses are requested on behalf of the customer and the information provided by the customer will be passed on to the relevant authorities who will decide if the allocation should take place or not. IP addresses will then be the property of the customer for an initial period of 6 month, renewable free of charge.
12 - We provide flexible pricing for our customers, however should the customer decide to cancel their contract before the expiry date and past the notice period, a fee of $99 (for dedicated server only) will be applied to the account. There is no minimum contract for mail/hosting packages.
a) This does not apply to customers who have paid the full setup fee *and* the full cost of the server/hosting/mailing package
b) Customers who have paid a reduced price for whichever reason (written proof provided by RH & Co. IT Services required) will be subject to the above fee if canceling after 1 month. This applies to Dedicated Servers and Additional IPs packages only.
c) Customers are allowed to cancel their additional IPs free of charge if keeping their Dedicated Server for a minimum period of 3 months.
d) The customer is the only entity responsible for its property and the use of it. We therefore recommend doing regular backups and install a firewall for protection against DDOS and other port scans (dedicated servers only).
Unless you have subscribed to one of our backup services, additional recovery costs will apply in the unlikely event something goes wrong due to your activities. If a hardware failure is the cause, no costs will be applied.
e) If the customer uses our servers for mailing purposes, we recommend setting it up properly following the Anti Spam guidelines.
f) A server may be shutdown in the event its IP / block of IP appears to be blacklisted or we receive a substantial amount of complaints. In such event, the data may be lost if no previous backup has been taken - RH & Co. IT Services will therefore take no responsibility for any damages and inconveniences caused.
The above rules have been put in place to protect RH & Co. IT Services and our Networks from leechers / P2P and email spammers.
13 - All provided IP addresses are thoroughly checked against major Real-time Black and Grey Lists before being assigned to the customer. We therefore cannot be held responsible if the actions of the customer have lead or will lead to the server being blacklisted.
However, depending on individual cases and stock availability, we may provide additional IPs free of charge providing that the customer makes a legal and legitimate use of his server.
14 - All Hosting packages are provided with the basic software and modules allowing the customer to run basic and advanced websites (ioncube, zend framework, PHP4 and PHP5 (PHP6 where available) etc...))
All Dedicated packages are provided 'raw' which means basic software (SSH for Linux) and updates are installed on delivery.
We do not install a specific flavor of Web Server because each customer has its own preferences. However installation of additional products (ie : multimedia packages) will be made at an additional cost
15 - Minimum Contracts
a) Hosting and Mailing packages have a 1 month minimum contract period - meaning the contract can be canceled by the customer 30 days after the date of activation. A 10 days notice before due date should be made in writing to RH & Co. IT Services (Live Support and other Instant Messaging methods are not valid proofs of cancellation requests)
b) Dedicated and cloud servers packages have a 2 months minimum contract period (unless previously agreed in writing by RH & Co. IT Services) - meaning the contract can be canceled by the customer 60 days after the date of activation. A 15 days notice before due date should be made in writing to RH & Co. IT Services (Live Support and other IM methods are not valid proofs of cancellation requests)
c) Dedicated backup packages have a 3 months minimum contract period (unless previously agreed in writing by RH & Co. IT Services) - meaning the contract can be canceled by the customer 180 days after the date of activation. A 30 days notice before due date should be made in writing to RH & Co. IT Services (Live Support and other IM methods are not valid proofs of cancellation requests)
16 - Bandwidth and Fair usage for all packages - Unlimited bandwidth explained
All packages come with unlimited bandwidth for legitimate purposes (ie: hosting / normal and legitimate emailing / streaming). It is very unlikely that you would exceed 2.5 TB of data transfer per month. If you think you will, please contact us before placing your order otherwise additional bandwidth will be charged at $0.0049 / MB
17 - Any package causing huge stress to our infrastructures or encouraging torrents/p2p, spamming and any other illegal application will be immediately suspended without possibility of refund.
18 - Any suspended service due to the reasons mentioned in .17 will have no possibility of refund.
19 - Invoices for hosting packages are sent within 10 days before the due date. If payment is not received 5 days after the due date, the dedicated server / web or mail hosting package is frozen. 5 days after the grace period, all data is erased and lost. During holiday periods, we may require at our own discretion an earlier or later payment of the due invoice(s).
20 - If the customer cannot pay before the due date for unfortunate reasons and wishes to carry on its services to the next month, a late-payment fee of $24.99 (servers) or $14.99 (mail and hosting) will be applied to the account. If an automatic payment has been suspended, it will be re-enabled for the following month.
21 - Invoices for projects are due within 7 days from the issue date.
22 - Guarantee Period
A guarantee period of 7 days is provided to the client for all projects (exc. hosting). During this period, we will make amendments and/or fixes free of charge, should the client discover an issue with their site.
Once the guarantee period expires, any amendments or fixes will be charged.
During or after the guarantee period, any amendments or fixes out of the initial project scope will be charged.
23 - You may not create a link to this website from another website or document without our prior written consent.
24 - These Terms and Conditions apply to all current and future contracts signed by our clients
25 - None of the text or images in this website may be copied and/or edited without the expressed written consent of its authors.
26 - These Terms and Conditions apply to every content of this website as well as projects made by us and do not affect your statutory right.
27 - These Terms and Conditions are subject to change without notice.
